1. PROMOTION DESCRIPTION. The Bigelow Tea / Market Basket Fenway Rivalry Game - Day Experience Sweepstakes (the “Sweepstakes”) may be entered online at http://www.bigelowtea.com/basket (“Website”); and via text message. Sweepstakes begins on 3/29/2023 at 12:00:00 a.m. Eastern Time (“ET”) and ends on 4/29/2023 at 11:59:59 p.m. ET.
2. ELIGIBILITY:The Sweepstakes is open only to legal residents residing in Connecticut, New Hampshire, Maine, Massachusetts, Rhode Island and Vermont who are eighteen (18) years of age or older at the time of entry. Employees of R.C. Bigelow, Inc. (“Sponsor”), DeMoulas Market Basket, Inc., the MLB Entities (defined below), each of their respective affiliates, subsidiaries, partners, advertising and promotion agencies (collectively, "Promotion Entities") and their immediate family members and/or those living in the same household of each are not eligible to participate. The “MLB Entities” shall mean the Office of the Commissioner of Baseball (“BOC”), its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P. (“MLB”), Major League Baseball Properties, Inc., The MLB Network, LLC, the Major League Baseball Clubs (“Clubs”), each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Clubs or the BOC and the owners, general and limited partners, shareholders, directors, officers, employees and agents of the foregoing entities. Void outside of Connecticut, New Hampshire, Maine, Massachusetts, Rhode Island, Vermont and where prohibited or restricted by law, rule or regulation. All federal, state and local laws and regulations apply.
3. HOW TO ENTER: There are two (2) ways to enter the Sweepstakes as follows:
   • A) TO ENTER VIA ONLINE: Go online to http://www.bigelowtea.com/basket and follow the instructions to complete your entry into the Sweepstakes.
   • B) TO ENTER VIA TEXT MESSAGE: Submit a text message containing the keyword “BASKET” to 844-301-0131 (the "Long Code") from your wireless device. In order to submit an entry by text message, entrant must (i) have a plan with a wireless carrier that includes a text messaging service; and (ii) use a wireless device that is capable of two-way text messaging. By sending a text message to enter, you signify that you understand that Sponsor will send a reply text message using an automatic dialing device to the phone number associated with the wireless mobile device you used to enter confirming your entry into the Sweepstakes and your consent to receive that message. You also consent to being notified via text message to the phone number associated with the wireless mobile device you used to enter if you are selected as a winner. If you do not want to receive any such text messages, then you should enter the Sweepstakes using the entry method described in rule #3A. YOU MAY BE CHARGED A FEE FOR MESSAGE TRANSMISSION AND DELIVERY BY YOUR CELLULAR NETWORK CARRIER. If you opt to enter via your wireless mobile device (which is not required to enter the Sweepstakes and may only be available via participating wireless carriers), standard text messaging and/or data rates may apply for each message sent or received from your handset according to the terms and conditions of your service agreement with your wireless carrier. Proof of text messaging the Keyword to the Long Code is not considered proof of delivery to or receipt by Sponsor of such Sweepstakes entry. Text entries must be completed by 4/29/2023 at 11:59:59 PM (ET). Text STOP to cancel.    Limit one (1) Sweepstakes entry per person, per Day - regardless of method of entry ("Maximum Number"). For purposes of these Official Rules, a “Day” is defined as any twenty- four (24) period beginning at 12:00:00 AM (ET) and ending at 11:59:59 PM (ET). Sponsor is not responsible for any change of mailing address, telephone number, and/or email address of entrants. In the event of a dispute over the identity of an entrant in the Sweepstakes, any text or online entries will be deemed to have been submitted by the Authorized Account Holder of the wireless device (text entry) or email address (online entry) submitted at the time of entry, provided that person meets all eligibility requirements set forth in these Official Rules. “Authorized Account Holder” means the natural person who is assigned to a wireless device number by a wireless service provider, Internet service provider, or other organization that is responsible for assigning wireless device phone numbers or email addresses associated with the submitted account. Entrants may not enter more than the Maximum Number of entries allowed with multiple wireless device phone numbers or email addresses. Any entrant who attempts to enter more than the Maximum Number using multiple wireless phone numbers, multiple email addresses or under multiple identities will be disqualified from participation in the Sweepstakes and all entries from that individual will be considered void. Potential winners may be required to provide Sponsor with proof that he/she is the authorized account holder of the wireless device account and/or email address associated with the winning Sweepstakes entry. If a dispute cannot be resolved to Sponsor’s satisfaction, the affected Sweepstakes entry will be deemed ineligible. Proof of submission will not be deemed to be proof of receipt by Sponsor. Only fully completed entries are eligible.
4. WINNER SELECTION: Potential winners will be selected in a random drawing on or about 5/1/2023 from among all eligible entries received from all methods combined by Sponsor or its designee, whose decisions are final and binding. Potential winners will be contacted by Sponsor or its designee by phone, mail and/or email. Subject to verification of eligibility and compliance with these Official Rules, the potential winners will be declared the official winners of the Sweepstakes.
5. PRIZES/APPROXIMATE RETAIL VALUES (“ARV”)/ODDS: Five (5) Grand Prizes — Each Grand Prize winner will receive a Fenway Rivalry Game-Day Experience package consisting of two (2) tickets for the winner and one (1) guest to attend the Boston Red Sox regular season game scheduled for 6/17/2023 at Fenway Park in Boston, MA; the opportunity for winner and guest to attend a pre-game tour of Fenway Park; and a Bigelow gift bag for winner only containing merchandise to be determined by Sponsor in its sole discretion (each a “Grand Prize”). ARV of Grand Prize is $141.00 ea. Transportation to/from the game and lodging is not included as part of the prize and will be the sole responsibility of each winner. Exact nature and duration of the pre-game tour shall be determined in the sole discretion of Sponsor and the Boston Red Sox and subject to availability. Use of any Major League Baseball game/event/exhibition ticket is subject to the standard terms, conditions, and health and safety policies applicable to the ticket; see redsox.com/ticketback for details. Seat locations at the game/event/exhibition and, unless otherwise stated in the prize description, exact game/event/exhibition date shall be determined in the sole discretion of Sponsor. Each winner’s guest(s) must be of legal age of majority in his/her(their) jurisdiction(s) of residence unless accompanied by a parent or legal guardian. Major League Baseball game/event/exhibition dates and times are determined in the sole discretion of the BOC and/or the applicable Club and may be subject to change. The terms and conditions of the tickets awarded as part of the prize will govern in the event a legal game/event/exhibition, as defined by Major League Baseball, is not played or held due to weather conditions, an act of God, an act of terrorism, civil disturbance, public health concern, public safety concern, or any other reason. Each winner and his/her guest(s) agree to comply with all applicable ballpark and venue regulations in connection with the prize. Sponsor and the MLB Entities reserve the right to remove or to deny entry to any winner and/or his/her guest(s) who engage in a non- sportsmanlike or disruptive manner or with intent to annoy, abuse, threaten, or harass any other person at the game/event/exhibition. Sponsor and the MLB Entities will not be responsible for weather conditions; acts of God; acts of terrorism; civil disturbances; local, state, or federal regulation, order, or policy; work stoppage; epidemic, pandemic, or any other issue concerning public health or safety; or any other event outside of their control that may cause the cancellation or postponement of any Major League Baseball game/event/exhibition. Major League Baseball game/event/exhibition tickets awarded as prizes may not be resold, offered for resale, or used for any commercial or promotional purpose whatsoever. Any such resale or commercial or promotional use may result in disqualification and prize forfeiture, and may invalidate the license granted by the game/event/exhibition ticket. Participation in the prize event is subject to winner’s (and guest’s) consent to and compliance with all health and safety policies of the MLB Entities, including but not limited to the wearing of masks if and when directed and the requirement to be fully vaccinated against COVID-19 (i.e., having received a final vaccination dose at least 14 days prior to the event). Twenty-Five (25) First Prizes – Each First Prize winner will receive one (1) $25 Market Basket Grocery Store Gift Card; and one (1) Bigelow gift bag containing merchandise to be determined by Sponsor in its sole discretion (each a “First Prize”). ARV of First Prize $50.00 ea. Gift cards are subject to the terms and conditions associated with their use. Total ARV of all prizes $1,955.00. Odds of winning depend on total number of eligible entries received from all methods combined. Unclaimed prizes will not be awarded. All applicable federal, state, and local taxes, if any, on prizes, and any other fees and expenses not specified associated with receipt or use of the prize are the sole responsibility of the prize winners. Limit one (1) prize per household/address.
6. GENERAL: Potential Grand Prize winners will be required to sign and return anotarized Affidavit of Eligibility/Liability Release and, where permitted by law, Publicity Release (“Winner Documents”) within five (5) days after first delivery attempt. Guest of a Grand Prize winner (if a minor, his/her parent or legal guardian must be the Grand Prize winner and must sign on his/her behalf) must sign and return a Liability/Publicity Release prior to awarding of prize. If prize notification or prize is returned as non-deliverable, prize may be forfeited and awarded to an alternate winner provided there is sufficient time remaining to award the prize (for Grand Prize). No correspondence will be acknowledged. No cash equivalents, substitutions or transfer of any prize permitted except that Sponsor reserves the right to substitute any prize of equal or greater value. By entering Sweepstakes, entrants agree to release and hold harmless Promotion Entities and their respective related companies, parents, subsidiaries, limited liability companies, affiliates, directors, officers, employees, assigns and their respective agents and agencies from and against any claim or cause of action arising out of participation or attempt to participate in the Sweepstakes or receipt or use of any prize. Entrants and winners (i.e. entrants that accept a prize) release and agree to indemnify and hold the Promotion Entities harmless against any and all claims and liability out of acceptance, possession, use or misuses of prize, or participation in this Sweepstakes. Where applicable, winners are solely responsible for the actions of his/her guests who accompany him/her to game. Promotion Entities will have no liability whatsoever for any injuries, losses or damages of any kind resulting from acceptance, possession, use and/or misuse of any prize or participation in the Sweepstakes or any prize-related activities. Acceptance of a prize shall be construed as and signify the winner's agreement and consent that Promotion Entities may use the winner's name, photograph, statements, voice, likeness and/or prize information, in perpetuity, worldwide, in any and all media now known or hereafter devised without limitation, for promotional purposes without further consideration, review, approval or payment, unless prohibited by law. By participating in this Sweepstakes, entrants agree to be bound by the Official Rules and the decisions of Sponsor, which are final and binding in all respects. Promotion Entities are not responsible for any typographical or other error in the printing of the offer or in administration of the Sweepstakes. Promotion Entities (a) make no warranty, guaranty or representation of any kind concerning any Prize (or any portion thereof), and (b) disclaim any implied warranty.
7. LIMITATIONS AND RELEASES: Any attempted form of entry into the Sweepstakes, other than the entry methods stated in rule #3, is prohibited. Promotion Entities are not responsible for lost, late, mutilated or illegible entries nor for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware, software, electronic, network, telephone or other communications malfunctions, errors or failures of any kind, errors in transmission, lost or unavailable network connections, telephone connections, wireless device connections, web site, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture or entry information (regardless of cause) or failed, incomplete, garbled, jumbled or delayed transmissions which may limit or restrict an participant’s ability to enter the Sweepstakes, including any injury or damage to participant’s or any other person’s phone, or other matter relating to or resulting from participating in this Sweepstakes or downloading any materials in the Sweepstakes. If for any reason any method of entry in the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes; and award the prizes via random drawing from among all eligible non-suspect entries received up to the action taken by the Sponsor provided a sufficient number of eligible entries have been received. Caution: Any attempt to deliberately damage any website or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any person responsible for the attempt to the fullest extent of the law.
